The suit involved one neighbor suing another over a tree with branches and limbs overhanging the property line. The neighbors assumed they could force Viking Law’s clients to pay all their costs for caring for their own lawn, as well as force the clients to have the large, healthy oak removed. ViKing Law was able to prove through a property survey that the tree was actually jointly owned (known as a “line tree”), was healthy, not causing a serious hazard, and therefore could not be destroyed. The neighbors were also advised to pay for their own yard clean up and self-help tree trimming. Judgement entered in favor of Viking Law’s clients.
